Service Description: On My Disk allows users to store, access, and share their personal files, photos, videos, and other content (“User Content”) from any device with an internet connection. The Service also provides users with the ability to collaborate with others by sharing User Content with others.
User Account and Responsibility: To use the Service, you must create an account and provide accurate and complete contact information (username, e-mail). Alternatively, you can use limited account corresponding to your On My Disk-enabled device identified by the device key. You are responsible for maintaining the confidentiality of your account password or device key for all activities that occur under your account. You agree to immediately notify On My Disk of any unauthorized use of your password or key.
User Content: On My Disk does not claim ownership of User Content, but you grant On My Disk a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy and distribute User Content shared publicly on your choice (shared by link with no password). You are solely responsible for the User Content you make available through the Service. You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases necessary to grant On My Disk the rights in such User Content, as contemplated under these Terms; and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor On My Disk's use of the User Content as permitted herein will infringe, misappropriate or violate a third party's patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
Proprietary Rights: On My Disk and its licensors retain all right, title, and interest in and to the Service, including all software, technology, and other proprietary components thereof, and any derivative works thereof. Except for the limited rights granted to you in these Terms, On My Disk and its licensors reserve all rights in the Service.
User Conduct: You may not use the Service to store, host, or transmit any User Content that: (i) is illegal, harmful, fraudulent, infringing, or otherwise malicious, or that could expose On My Disk or its users to harm; (ii) is violent, obscene, defamatory, or otherwise objectionable; or (iii) violates the privacy rights of others. On My Disk reserves the right to remove access to any User Content that violates these Terms or applicable law and to terminate your account for repeated violations.
